Aerial Surveying Operations Under Part 108

About

Aerial surveying, mapping, and inspection operations would gain a clearer regulatory path under Part 108. Lower-risk surveying missions could operate under a permit, while larger-scale or more complex inspection work would fall under the certificate framework.

Key Attributes

  • Authorization Pathway: Operating Permit (smaller scale) or Operating Certificate (larger scale or higher complexity)
  • Maximum Takeoff Weight: Up to 110 pounds under Permit; greater flexibility under Certificate (up to 1,320 pounds in some cases)
  • Population Density Categories: Up to Category 3 under Permit; Certificates allow operations in Category 4 and higher with appropriate mitigations
  • Fleet / Scale Limits (Permit): Proposed limits around 25 active aircraft for surveying-type operations
  • Additional Requirements: Strategic deconfliction in Category 3+, appropriate detect-and-avoid capabilities in higher-risk environments, and standard recordkeeping

What This Means for Operators

Surveying and inspection companies currently operating under Part 107 waivers or exemptions will have a more predictable path to routine BVLOS. Those already using robust manuals and safety systems will transition more easily.
