The Regulatory Shift to Routine BVLOS under Proposed Part 108

  

The August 7, 2025 NPRM marks a deliberate normalization of BVLOS as the standard for scalable UAS operations rather than the exception. 


Key elements of this shift include:

  • Performance-based      framework —      Instead of mandating specific technologies or constant human visual      observation, the rule sets safety outcomes (well-clear maintenance,      strategic deconfliction, conformance to operational intent) that operators      must demonstrate through layered mitigations.
  • Automation-centric      operations —      Highly automated UAS with supervisory oversight replace pilot-in-the-loop      control (Chapter 3).
  • Risk-tiered      authorizations —      Operating permits for lower-risk operations and operating certificates      (with mandatory SMS) for higher-risk or larger-scale fleets.
  • Supporting      infrastructure —      Mandatory integration with Part 146 Automated Data Service Providers      (ADSPs) for real-time traffic awareness and strategic conflict resolution.


This moves UAS from a waiver-dependent patchwork to standardized, routine low-altitude BVLOS capability, unlocking commercial and public benefits while maintaining or improving safety.
